The Petitioner apprehends his arrest in Kotwali (Adampur) P.S. Case No.479 of 2016 instituted for the offence under Section(s) 409, 420 Indian Penal Code.

It is alleged that the petitioner did not submit folder of merit list and other documents relating to appointment of contractual teacher to the Vigilance Officers in terms of the direction of the Hon'ble Court given in CWJC No.15459 of 2014. It has been submitted on behalf of the petitioner that he was not posted in the aforesaid Panchayat at the relevant time and he was not handed over charge of all these documents and,

Patna High Court Cr.Misc. No.6526 of 2017 (4) dt.30-03-2017 2/2 therefore, he could not submit merit list of selected candidates. He has been posted in Nadiyama Panchayat in the year 2016. In the facts and circumstances of the case, prayer of the petitioner for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Kotwali (Adampur) P.S. Case No.479 of 2016, he shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, subject to the conditions as laid down under Section 438(2) Cr. P. C.
