The petitioner seeks bail in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 108 of 2019 registered for the offences punishable under Sections 25(1-a), 25(1-AA), 25(1B)a, 26 and 35 of the Arms Act. Prosecution case is that the police received secret information regarding manufacturing of country made fire arms going on in the village. The police along with other police personnel reached village Paharpur at the house of Devwaki Mandal which was raided where it was found that three persons holding country made Katta were sharpening it and three persons were watching them and noticing arrival of the police they started fleeing away but some of the said persons were

Patna High Court CR. MISC. No.18528 of 2020(4) dt.09-07-2020 2/2 captured. After search, the incriminating articles including semi manufactured country made fire arms and tools were recovered. Accordingly, seizure list was prepared in presence of independent witnesses.

Learned counsel for the petitioner submits that the petitioner is quite innocent and has committed no offence. He further submits that co-accused Pintu Mandal and Debaki Mandal have been granted regular bail by this Co-ordinate Bench of this Court.

Learned A.P.P. for the State has opposed the prayer for bail.

In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of Sri R. Kumar-VI, learned J.M. 1st Class, Saharsa in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 108 of 2019. (Anjani Kumar Sharan, J) Nasimul/- U T
