====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 07-12-2021 Heard Mr. Arvind Kumar Singh, learned counsel for the petitioner and Mr. Satyadeo Singh Yadav, learned Additional Public Prosecutor appearing for the State.

Petitioner seeks regular bail in connection with Mahila P.S. Case No. 17 of 2020 registered for the offences punishable under Sections 376, 504, 506 and 509 of the Indian Penal Code 1860.

The allegation as per the First Information Report is that the petitioner entered into the house of the informant and committed rape upon her.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case inasmuch as sister-in-law (Nanad) of the informant was also sleeping in

No.29278 of 2021(3) dt.07-12-2021 2/2 another room, but it does not stand to the reason that when the door of the informant was being knocked by the petitioner, the sister-in-law (Nanad) of the informant did not wake up. On the other hand, learned counsel for the State submits that the involvement of the petitioner in the offence has been corroborated by the informant in her statement recorded under Section 164 Cr. P.C. and the victim is aged about twenty years.

Regards being had to the submission made by the parties and taking into consideration the nature of allegation and the statement of the victim lady (informant) recorded under Section 164 Cr. P.C., I am not inclined to grant regular bail to the petitioner.

Accordingly, the prayer for bail of the petitioner stands rejected.
