Rita Verma, learned Addl. Public Prosecutor.
The petitioner, who is in custody only since 07.08.2016 in Nardiganj P.S. Case No.112 of 2016 registered for the offence under Sections 20/22/24 of the Narcotics Drugs and Psychotropic Substances Act, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that recovered ganja is lesser than the small quantity i.e. 500 gms. and, as such, it is case for grant of bail, whereas learned Addl. Public Prosecutor, oppositing the prayer for grant of bail, submits that besides recovery of 500 gms Ganja , 20 Puriyas of
Patna High Court Cr.Misc. No.41707 of 2016 (3) dt.05-12-2016 2/2 Ganja were also recovered, which suggests that the petitioner was indulged in selling of ganja.
Keeping in view the nature of accusation and period of custody, at the moment I am not inclined to grant bail. The petition stands dismissed.
