2. The petitioner is in custody in connection with Special (POCSO) P.S Case No. 306 of 2023 registered for the offences punishable under Sections 363 of the I.P.C.
3. As per prosecution case, the informant's minor niece, the victim girl aged about 17 years went to attend exmination at Gardanigabh Mahila College, Chitkohra from his house but till late hours she did not return the informant and his family members searched her everywhere but in vain. It is alleged that on asking

No.25084 of 2024(2) dt.08-04-2024 2/3 from the friends of the victim girl they got knowledge that the victim girl had given examination at first sitting but she had not given exam at 2nd sitting and she was a college uniform. Thus, the case was registered against unknown as specified.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that name of the petitioner surfaced on the basis of the suspicion. It is next submitted that offence under Section 363 is bailable in nature. Petitioner has got no criminal antecedent as stated in para 3 of the bail petition. It is also submitted that petitioner is in judicial custody since 26.11.2023.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR, impugned order and period of custody and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds
