The petitioner is in custody in connection with Special Case No. 12323 of 2018, arising out of Bhagwanganj P.S. Case No. 173 of 2018 registered for the offence punishable under Section 30 (a) (c) (d) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that in the instant case total 10 liters of Mahua wine was seized. Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner rather the same liquor was seized from Bush near Punpun river. He submits that petitioner is in custody since 15.02.2019.

No.19745 of 2019(2) dt.01-04-2019 2/2 Considering the fact that nothing was recovered from conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner, Let, the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Special Judge, Excise, Patna in connection with Special Case No.12323 of 2018, arising out of Bhagwanganj P.S. Case No. 173 of 2018.
