The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016 and sections 272, 273 and 34 of the Indian Penal Code.

As per the prosecution case, on raids being conducted at different places a total of 299.025 litres of liquor was recovered.

It is submitted by learned counsel for the petitioner that from perusal of the F.I.R. it would transpire that the petitioner was neither arrested at the spot nor any incriminating article has been recovered from his possession. In course of the raids his name transpired as being part of the members of the team which was dealing in liquor. The petitioner has been

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner being in custody for over 10 months, the Court directs the petitioner to be enlarged on bail in connection with Rosera P.S. Case no.216 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Excise, Samastipur.
