In this case, the petitioner is seeking bail in connection with Obra P.S. Case No. 66 of 2017 registered for offences under sections 392 of the Indian Penal Code. The petitioner is a history-sheeter having eight cases over his head. In the present case also, there is an allegation of road robbery against him.
Learned counsel for the petitioner submits that the petitioner has remained in jail custody fore more than one year and, in all other cases, he has been granted bail. Looking to the entire facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
Patna High Court CR. MISC. No.18654 of 2020(2) dt.08-07-2020 2/2 sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Obra P.S. Case No. 66 of 2017, subject to the condition that (i) one of the bailors shall be the wife of the petitioner, (ii) the petitioner would cooperate the proceeding of the court below and in the event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds and (iii) the petitioner will report to the Obra police station by 7th of every month for at least one year and in case of failure without any valid rhyme or reason, the bail of the petitioner will be treated to have been canceled.
