JUSTICE SUDHIR SINGH ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Saharsa SC/ST P.S. Case No. 13 of 2015 for the offences instituted under Sections 379, 341, 323, 504, 506/34 of the IPC and 3(1)(x) of the SC/ST (Prevention of Atrocities) Act. The prosecution story, in brief, is that on 30.03.2015 the informant being the Mahadalit Bikas Mitra was returning from Simri Bakhtiarpur Prakhan Office after attending weekly meeting to Belwar Panchayat Office and when reached near Bhaura Bridge then Ranjit Singh alongwith three unknown miscreants by forcibly get him down from the Motorcycle and abused him by calling his

No.39785 of 2015 (2) dt.01-10-2015 2/3 caste name and put knife on his temple and demanded Rs.10,000/- as Rangdari and they snatched Rs. 5,000/- from his pocket and the unknown miscreant snatched his wrist watch, fisted and slapped him and threatened him. It is alleged that due to arrived of passer by he was saved.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the date of occurrence is said to be 24.03.2015 but the case has been instituted on 30.03.2015 for which no explanation has been made on behalf of the prosecution which casts serious doubt upon the prosecution. So far as offence under SC/ST Act is concerned, the same has not been made out against the petitioner. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Saharsa SC/ST P.S. Case No. 13/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa, subject to the conditions as laid down under Section 438(2) of the Code of
