The petitioner apprehends his arrest in connection with Nawada Town P.S. Case No. 661 of 2016, registered under Sections 384 and 506/34 of the Indian Penal Code and Section 3/5 of the Explosive Substance Act.
The accusation is that, on 24.11.2016, in the morning, some miscreants came at the door of the informant, Santosh Kumar, and hurled the Bomb and also dropped letter through which demanding ransom. The informant gave
information on 29.07.2016, 01.08.2016, 20.08.2016 and 17.11.2016, to the Officer-in-charge, Nawada Police Station and Superintendent of Police, Nawada, but no action was taken due to that reason they again hurled the bomb at the door of the informant, in which, Jeetu Singh, Badri Singh and Satish Singh having their hand and the petitioner being Director of Bahe Guru Construction has also hand in the occurrence. Learned counsel for the petitioner submits that, in fact, there is land dispute in between the F.I.R. named accused persons and the informant, regarding which, Title Suit No. 473 of 2016 is pending in the court of Sub-Judge, Nawada. In fact, petitioner is the relative of F.I.R. named accused persons due to that reason his name has been disclosed by the informant. Further submission is that petitioner is accused in one another case, in which, he is on bail.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Nawada Town P.S. Case No. 661
of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
