Petitioner seeks bail in connection with Laheriasarai P.S. Case No. 257of 2016 registered for the offences punishable under Sections-401/414/467/468/471 of the Indian Penal Code. The name of the petitioner came in this case when one Md. Reyaz was arrested in connection with Laheriasarai P.S. Case No. 220 of 2016, who disclosed that he as well as the petitioner along with others committed the aforesaid loot. Submission is that nothing has been recovered from possession of the petitioner. His name has come in confessional statement of co-accused. Save and except, there is nothing against
Patna High Court Cr.Misc. No.3495 of 2017 (2) dt.27-02-2017 2/2 the petitioner. The other co-accused Amit Kumar and Md. Rayaz have already been allowed bail by another coordinate benches of this court and as such, the petitioner also deserves sympathetic consideration.
The learned APP opposes the prayer of bail.
In the facts and circumstances stated above, considering that Md. Reyaz and co-accused Amit Kumar have already been allowed bail and as such, the petitioner named above, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Laheriasarai P.S. Case No. 257 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Darbhanga. (Jitendra Mohan Sharma, J) A.K.V./- U T
