JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 382of the IPC.

Neither the petitioner is named in the First Information Report nor any thing has been recovered from his conscious possession. The impugned order goes to show that name of petitioner transpires in course of investigation and except the aforesaid fact as well as some criminal antecedent, there appears nothing against the petitioner. Moreover, it is informed that having similar allegation, one co-accused, namely, Shatrudhan Chaudhary has already been granted privilege of bail by co-ordinate Bench of this Court vide order dated 01.10.2018 passed in Cri. Misc. No.

Patna High Court Cr.Misc. No.66572 of 2018 (2) dt.22-11-2018 2/2 53749 of 2018.

Accordingly, petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Hajipur town P.S. Case No. 116 of 2017.
