JUSTICE ARUN KUMAR ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 412, 413, 141, 419, 420, 467, 468, 471, 120(B) of the Indian Penal Code and Section 25(I-B), a 26 and 35 of the Arms Act.

It is alleged that police raided the house of one Md. Shahid Ekbal that he used to procure stolen vehicle and after tampering engine and chessiss numbers used to procure forged registration document from transport office, on spot, three persons were apprehended including this petitioner. The specific allegation against the petitioner is that on his body search police recovered one country made pistol with a cartridge.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.53723 of 2016 (2) dt.14-12-2016 2/2 petitioner has falsely been implicated and has got no criminal antecedent and has been in custody in this case since 4.7.2016, i.e., for five months.

Considering the fair antecedent and period of custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-V, Vaishali, Hajipur in connection with Kartaha P.S. Case No.40 of 2016.
