The petitioner apprehends his arrest in Madanpur P.S. Case No. 141 of 2016, registered for the offences punishable under Sections 341, 323, 326, 307 and 34 of the Indian Penal Code.

The informant named ten persons including the petitioner Kamlesh Yadav and alleged that for blockage of drainage the petitioner assaulted his father Devan Yadav with Garasa on his head.

Learned counsel for the petitioner submits that there is a counter version being Madanpur P.S. Case No. 142 of 2016. The petitioner is co-sharer of the informant. Devan Yadav and others have already been granted anticipatory bail vide order passed in Cr. Misc. No. 15562 of 2017 but it appears from the perusal of the

Patna High Court Cr.Misc. No.16195 of 2017 (2) dt.27-04-2017 2/2 record that on account of assault made by the petitioner Devan Yadav got grievous injury on his head.

Considering the facts aforesaid and the fact that on account of assault made by the petitioner father of the informant got grievous injury on his head, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
