JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Kanti P.S. Case No. 706 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The accusation is that in the evening of 18.09.2019, informant and other Police personnel received information about keeping of liquor in the hut by Jitendra Kumar @ Golu Thakur (Petitioner) in village-Arara. The informant along with other Police personnel reached in village-Arara near the hut then a person was seen fleeing from the hut, while he was chased, but he succeeded to flee away. On search, several bottles of Indian made foreign liquor in total volume of 2240.49 liters recovered. The persons present
Patna High Court CR. MISC. No.19213 of 2020(2) dt.05-06-2020 2/2 there disclosed that the hut is belonging to the petitioner. Learned counsel for the petitioner submits that, in fact, petitioner is accused in two other cases, as detailed in paragraph No.3, out of which Kanti P.S. Case No. 337 of 2019 is of similar nature due to that reasons, the informant implicated the petitioner in the present case showing disclosure made by persons present there that the hut from where the alleged Indian made foreign liquor is said to be recovered belonging to the petitioner. The petitioner is in custody since 27.01.2020.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Kanti P.S. Case No. 706 of 2019.
