The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 363, 366A and other Sections of the Indian Penal Code.
The mother of the victim made allegation that Mohan Kumar Sah kidnapped her minor daughter for the purpose of marriage. Arun Sah the father and the petitioner mother of Mohan Kumar Sah have helped him. When the informant went to the house of the petitioner, the petitioner and her husband are alleged to have abused and assaulted the informant.
It is submitted that the informant is not an eye witness of the occurrence. When the informant visited the house of the petitioner the petitioner was found present. The informant only
Patna High Court Cr.Misc. No.40652 of 2015 (2) dt.06-10-2015 2/2 raised suspicion against the petitioner that she might have helped her son in kidnapping the daughter of the informant. Considering the facts aforesaid and the fact that the petitioner is a lady, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Kotwali (Barari) P.S. Case No. 275 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
