The petitioner seeks bail in connection with Sadar (Mufassil) P.S. Case No.100 of 2016 registered under Sections 363, 366A, 323, 504/34 of the Indian Penal Code. Referring to the age given in the FIR, it is submitted that the petitioner is aged about 19 years whereas the victim of the case is of 17 years. They were having affair from before and on the date of occurrence the victim out of her sweet will went together with the petitioner. The victim has already come back and has made her statement under Section 164 of the Code of Criminal Procedure wherein she has levelled certain allegations against the petitioner which are tutored one.
Learned counsel for the State has opposed the
Patna High Court Cr.Misc. No.35323 of 2016 (2) dt.22-08-2016 2/2 application for grant of bail to the petitioner. He has submitted that the offence is serious in nature and the petitioner has not remained in jail for sufficient period.
Be that as it may, regard being had to the facts and circumstances of the case, the petitioner, namely, Vikash Kumar Mehta is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Sadar (Mufassil) P.S. Case No.100 of 2016.
