The petitioner is apprehending his arrest in connection with Lakhisarai P.S. Case No. 471 of 2016, registered under section 306 of the Indian Penal Code.

Allegation against the petitioner is that he is the husband and he assaulted the deceased due to which she along with her four children committed suicide.

It has been submitted on behalf of the petitioner that there is no allegation of either demand or torture against the petitioner and no such case was earlier filed and the petitioner has falsely been implicated in this case.

Heard learned A.P.P. also who has opposed the prayer for bail and submitted that due to torture and harassment, the deceased had committed suicide along with her four children.

No.16637 of 2017 (3) dt.01-05-2017 Having heard both sides and in view of the direct allegation, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid observation, this application is disposed of accordingly.
