The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,307,379,504 and 354 of the Indian Penal Code.
The prosecution case is that the accused persons came variously armed to the land of the informant and on protest being made the petitioner assaulted with farsa on the head of the informant causing cut injury. When the informant fell down on the ground, his son and daughter in law came to rescue then co accused Ranjeet Pd. Singh assaulted with rod on the arm of the informant's son, co accused Ashok Pd. Singh assaulted with lathi to the daughter
Patna High Court Cr.Misc. No.41754 of 2015 (2) dt.09-10-2015 2/3 in law of he informant on her abdomen and chest and the sons of Upendra Pd. Singh and Ambika Pd. Singh assaulted with rod and lathi. It is further alleged that the accused persons snatched gold ear ring of the informant's daughter in law.
It is submitted by the learned counsel for the petitioner that in the background of land dispute the accusation has been levelled as the land in question was purchased by the petitioner side in 1956 whereas the same land was purchased by the father of the informant Ritu Rai in 1958. The injury of the informant and his wife have been found to be simple in nature caused by hard and blunt substance whereas it is alleged that the petitioner assaulted with sharp cutting weapon. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at
