JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-302 & other minor sections of the Indian Penal Code. Petitioners and several other accused are named in the first information report on the accusation that they committed murder of informant's son.

Submission on behalf of petitioners is that no specific overt act has been attributed against the petitioners and, some other accused faced trial and they were acquitted under Section232 of the Cr.P.C. vide order dated 27-02-2015 passed in S.Tr. No. 370 of 2014 and therefore, there is no scope of conviction of

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Panapur P.S. Case No. 06 of 2014 to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Saran, Chapra.
