JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Dhaka P.S. Case No. 146 of 2018 dated 05.05.2018 instituted for the offences under Sections 420, 467, 468, 471, 323, 504, 34 of the Indian Penal Code. From the perusal of the F.I.R, it would appear that with respect to an exchange deed of the year 1998, the F.I.R has been lodged in the year 2018.

It has been alleged that the petitioner along with others, by befooling the informant, has got a wrong land transferred/exchanged in place of the land of the petitioner. The assurance of the petitioner and others of compensating

The learned counsel for the petitioner has submitted that after full knowledge of all the facts, the informant agreed for exchange deed and he cannot be permitted to rake up the issue after more than twenty years. The petitioner does not have any criminal antecedents.

Regard being had to the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender within a period of four weeks from today before the learned Court below, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dhaka, East Champaran in connection with Dhaka P.S. Case No. 146 of 2018, G.R. Case No. 509 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Shageer/- U T
