The petitioner apprehends his arrest in connection with Sadar P.S. Case no. 386 of 2016, registered under Sections 353 and 386 of the Indian Penal Code.
The accusation is that on 05.10.2016 informant being the Police constable was on duty at Railway Gumati at Khuskaibagh in the mean time, he received call on his mobile in which instruction was made for coming to Pratyak News Office. Thereafter, he went to Pratyak news office situated at Katihar turning, where petitioner Prafull Omkar Jha and one Sachin Bhagat were present and both were introduced themselves as In-charge of Pratyak News and asked to give ransom of Rs. 50,000/- and also threatened that if the ransom is not paid, he will have to face dire consequences and he would be suspended.
Patna High Court Cr.Misc. No.5084 of 2017 (3) dt.27-03-2017 2/2 Learned counsel for the petitioner submits that petitioner being the bureau of Pratyak News, made complaint about extortion by the informant to the people due to that reason, this false case has been lodged. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No. 386 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
