JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-10-2018 Heard the parties. The petitioner seeks regular bail in connection with Natwar P.S.Case No. 42 of 2018, registered for the offence under Sections 25 (1-b) a/26 of Arms Act.

Allegation against the petitioner as per F.I.R. is of recovery of one country made loaded katta and of 12 Bore and two live cartridges from cow-shed of the petitioner and accordingly, a seizure list has been prepared. It is also alleged that the petitioner is an accused in three other cases also. Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case and nothing has been recovered from the possession of the petitioner and the petitioner is in custody since 07.02.2018.

Patna High Court Cr.Misc. No.64775 of 2018 (2) dt.29-10-2018 2/2 Heard learned A.P.P. also who opposed the prayed for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage. However, the petitioner may renew prayer for bail after framing of charge.

With the aforesaid observation, the instant petition is accordingly dismissed.
