JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-06-2020 The petitioner seeks bail in connection with Special Excise Case No. 3438 of 2019 arising out of Barh P.S. Case No. 163 of 2019, dated 29.03.2019, instituted for the offences under Sections 147, 148, 149, 307, 353, 120B and 323 of the Indian Penal Code, Sections 25(1-b)A, 26, 27 and 35 of the Arms Act and Sections 30(A), 38 and 41 of the Bihar Prohibition and Excise (Amendment) Act, 2016. 85 litres of liquor was recovered from the possession of the petitioner.

It has been submitted on behalf of the petitioner that he has been falsely implicated in this case and the so-

Patna High Court CR. MISC. No.19244 of 2020(2) dt.08-06-2020 2/2 called recovery has wrongly been saddled upon him. The petitioner is stated to be in custody since 27.01.2020.

Considering the period of custody of the petitioner and the nature of accusation against him, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Excise Case No. 3438 of 2019 arising out of Barh P.S. Case No. 163 of 2019.

The application stands allowed.
