JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 Petitioner seeks regular bail in connection with Mahkar P.S. Case No.174 of 2017 registered for the offences punishable under Sections 341, 323, 325, 307, 504 and 302 of the Indian Penal Code.
Allegation as per F.I.R. against the petitioner is that petitioner and other co-accused persons assaulted the father of the informant, causing his death.
Submission of the learned counsel for the petitioner is that the F.I.R. itself shows that there is no specific allegation against this petitioner and several other accused persons have been granted bail by a Co-ordinate Bench of this Court vide order dated 08.05.2018 passed in Criminal Misc. No.21136 of 2018 and one of them by this Court vide order dated 02.11.2018 passed in Criminal Misc. No.52208 of 2018 and the petitioner is
Patna High Court CR. MISC. No.19009 of 2019(2) dt.21-05-2019 2/2 in custody since 26.10.2018.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Mahkar P.S. Case No.174 of 2017, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
