JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-08-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 19.12.2019 in connection with Athmalgola P.S.Case No. 225 of 2014 registered under section 304B, 201/34 of the Indian Penal Code.

Petitioner happens to be father-in-law of the deceased and no specific allegation of demand of dowry as well as torture has been levelled against him.

However, it would appear from perusal of the record as well as submission of the parties that police after due investigation submitted charge sheet against the husband of the deceased and investigation against the petitioner was kept

Patna High Court CR. MISC. No.20491 of 2020(2) dt.27-08-2020 2/2 pending. The husband of the deceased faced trial in Session Trial no. 910 of 2015 but in course of trial, the informant as well as other natal people of the deceased were declared hostile and thereafter, the husband of the deceased was acquitted of the charges.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge1st, Barh, Patna in connection with Athmalgola P.S.Case No. 225 of 2014.
