The petitioner seeks bail in a case instituted for the offence under Sections 272, 273 of the Indian Penal Code and Section 47 of Bihar Excise (Amendment) Act, 2016. It has been submitted on behalf of the petitioner that total five bottles of 375 ml. of Royal Stag foreign liquor has been recovered from shop of the petitioner. Seizure list is available along with written report at page-18 of the bail petition, which shows that five litres of the foreign liquor has been recovered. Seizure list bears the signature of the petitioner. Petitioner is said to be in custody since 23.10.2016. Therefore, keeping in view the period spent by the petitioner in

Patna High Court Cr.Misc. No.341 of 2017 (2) dt.30-01-2017 2/2 custody, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P.S.
