JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Mashrak P.S. Case No. 253 of 2016 registered for the offences punishable under Sections 413, 414 of the Indian Penal Code. Taking into consideration that name of petitioner was disclosed by co-accused, Uday Singh, who stated that he had sold the stolen bicycles to the petitioner and thereafter, some parts of bicycles were recovered from the shop of the petitioner, I do not feel it proper to extend the privilege of anticipatory bail to petitioner. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Mashrak P.S. Case No. 253 of 2016 pending in the court of Additional Chief Judicial Magistrate-VIII,

Patna High Court Cr.Misc. No.45039 of 2016 (2) dt.16-12-2016 2/2 Saran, Chapra stands rejected.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
