JUSTICE SANJAY PRIYA ORAL ORDER 06-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Naubatpur P.S. Case No. 198 of 2018 instituted for the offence under Section 379 of the Indian Penal Code.
It is alleged in the written report that on 29.04.2018, the informant went to village Taret Pali and parked his Motorcycle near Samiyana. Thereafter, he went to take food. After two hours, the informant returned back and found his motorcycle missing.
Counsel for the petitioner submits that petitioner is in custody since 22.06.2018. He has no criminal antecedent. There is no recovery of any incriminating article from his possession. He is not named in the written report. Counsel for the petitioner
Patna High Court Cr.Misc. No.66260 of 2018 (2) dt.06-11-2018 2/2 further submits that petitioner is not named in the written report. The learned Sessions judge has mentioned in the impugned order that alleged Motorcycle has been recovered on the basis of confessional statement of petitioner Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Distt.
