JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2015 Heard learned counsels for the petitioners, informant and learned counsel for the State The petitioners are apprehending their arrest in connection with Chakia P.S. Case No. 119 of 2014, arising out of G.R. Case No. 1956 of 2014, for the offences instituted under Sections 341, 307, 323, 324, 504, 506/34 of the IPC and 3(1)(x) of the SC/ST (Prevention of Atrocities) Act.

The accusations are of abusing the informant by calling caste name and assaulting the informant and his son by all the accused persons.

It has been submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case. So far

Patna High Court Cr.Misc. No.39643 of 2015 (2) dt.30-09-2015 2/2 as the provision of SC/ST Act is concerned, the same is not made out against the petitioners. From perusal of Annexure- 3 which is the injury report, it appears that the nature of injury is simple. On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of four weeks from today in connection with Chakia P.S. Case No. 119/2014, arising out of G.R. Case No. 1956 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Sadar at Motihari, East Champaran, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
