Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b) a, 26, 35 of the Arms Act.

Admittedly, the alleged recovery has not been made from conscious possession of the petitioner and the name of petitioner was disclosed by the persons who had assembled at the place of occurrence. Moreover, the informant has not mentioned the name of those persons, who claimed to have identified the petitioner. No doubt, petitioner does have criminal antecedent of ten cases but in the present case, there appears to

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 1071 of 2018.
