JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-03-2017 The petitioner is apprehending his arrest in connection with Mahila P.S. Case No. 81/16, registered for offences punishable under Sections 498A and 34 Indian Penal Code and Section 3/4 of Dowry Prohibition Act.

It has been submitted by learned counsel for the petitioner that petitioner is still ready to keep the informantopposite party no. 2 with him but with the condition that she will have to live in her matrimonial house.

Heard learned A.P.P. as well as learned counsel for informant-opposite party no. 2. Learned counsel for the informantopposite party no. 2 has submitted that she is also ready to live with the petitioner, if she is kept with full honour and dignity. In view of submission of learned counsel for the parties,

Patna High Court Cr.Misc. No.12461 of 2017 (2) dt.24-03-2017 2/2 let petitioner surrender before the Court below on 03.04.2017 on which date opposite party no. 2 shall also present herself and the court below after satisfying himself with the conduct of the petitioner and if it is found that he is ready to keep his wife with full honour and dignity and is ready to take her, shall enlarge the petitioner on provisional bail to his satisfaction for a period of six months and watch their conduct during that period and direct the petitioner and the informant-opposite party no. 2 to appear in the court below on each month on the date fixed by the court below and the court below only after satisfying himself with the conduct of the petitioner as well as opposite party no. 2 and also after satisfying himself with the status of matrimonial life of the parties, shall confirm the provisional bail of the petitioner, otherwise, he is free to pass any order as he deems fit and proper. With the above observation, this application is disposed of.
