JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-04-2022 The present petition is by way of fourth attempt at the behest of the petitioner for grant of bail in connection with S.T.No. 508/2018 arising out of Jamo Bazar P.S.Case No. 77/2018 under Sections 147, 148, 149, 341, 323, 324, 307 and 302 of the Indian Penal Code inasmuch as the earlier prayer of the petitioner for grant of bail has been rejected by this Court vide orders dated 9.1.2019, 9.6.2020 and 11.8.2021 passed in Criminal Miscellaneous No. 68863 of 2018, Criminal Miscellaneous No. 74844 of 2019 and Criminal Miscellaneous No. 21473 of 2021.

A specific allegation has been levelled

Patna High Court CR. MISC. No.20966 of 2022(2) dt.27-04-2022 2/2 against the petitioner of him having assaulted the deceased resulting in his death.

The learned counsel for the petitioner has submitted that the petitioner is languishing in custody since 8.6.2018 without any substantial progress in the trial.

I have heard the learned counsel for the parties and I find that there is no change in circumstance so as to warrant reconsideration of the prayer of the petitioner for grant of bail, especially on account of the heinous crime committed by the petitioner herein, apart from the fact that charges have already been framed by the learned trial court and the trial is going on, hence, I do not find any merit in the present petition, accordingly, the same stands dismissed.
