JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2018 The petitioners seek regular bail in connection with Gaunaha P.S. Case No. 122 of 2017, registered for offences punishable under Section 394 of the Indian Penal Code. Allegation as per F.I.R. is that the informant, who was posted as Manager in Bharat Finance Limited, Narkatiaganj Branch and on 21.12.2017, while he was returning after collecting Rs. 92,662/- from different Mahila Sangh along with one staff, three miscreants appeared and on the point of pistol, they snatched away the collected money of Rs. 92,662/- and also the informant's money Rs. 4050/- and a mobile and Rs. 6000/- from the staff of the informant.

No.65447 of 2018(2) dt.20-11-2018 2/2 It has been submitted on behalf of the petitioners that they are not named in the F.I.R. and have falsely been made accused in this case only on the confession of co-accused and the petitioners have been remanded in this case from another case and have been in custody since 09.03.2018. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, West Champaran, Bettiah, in connection with Gaunaha P.S. Case No. 122 of 2017, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
