JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Taking into consideration that the victim has specifically stated in her statement recorded under section 164 of the Cr.P.C that petitioner made attempt to commit rape on her, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with POCSO Case No. 10 of 2016 arising out of Buxar ( Mahila) P.S.Case No. 35 of 2016, pending in the court of Additional Sessions Judge 1st , Buxar cum Special Judge POCSO Act , Buxar stands rejected.
However, the learned trial court should expedite the trial of the petitioner and try to conclude the same as early as
Patna High Court Cr.Misc. No.44862 of 2016 (3) dt.28-11-2016 2/2 possible, within six months, from the date of receipt/ production of a copy of this order.
