The petitioner seeks modification of the order dated 12.06.2020, passed in Cr. Misc. No. 60740 of 2019, whereby the petitioner's prayer for anticipatory bail was allowed on the condition of his depositing Rs.2,50,000/- (Two Lakhs Fifty Thousand) by demand draft in favour of Opposite party no. 2 and balance of 2,50,000/- (Two Lakhs Fifty Thousand) within three months. The petitioner could not comply with the said

Patna High Court CR. MISC. No.24348 of 2022(9) dt.07-12-2022 2/2 order to avail the benefit of the same within the time specified in order dated 12.06.2020, passed in Cr. Misc. No. 60740 of 2019. The petitioner's counsel has handed over to the counsel for the Opposite party no. 2 a demand draft drawn on HDFC Bank, bearing no. 004081 for the entire amount of Rs. 5,00,000/- (Five lakhs). The petitioner counsel has further submitted that to establish the bona fides, he would be depositing a lump sum amount of Rs. 25,000/- at the time of furnishing bail bonds in view of the delay being caused in deposit of the amounts.

In view of the aforesaid submissions, and subject to depositing of the remaining Rs. 25,000/-, the order dated 12.06.2020, passed in Cr. Misc. No. 60740 of 2019, stands modified so as to enable the petitioner to surrender for availing the benefits of the order dated 12.06.2020 within six weeks. (Madhuresh Prasad, J) Raj kishore/- U
