Issuance of a direction, order or writ in including writ in the nature of Mandamus commanding the concerned respondent authorities to take step towards payment of all legal dues and appointment on compassionate ground on the post fourth grade is the office respondent no. 02. Petitioner is the dejure wife (widow) of the late Pankaj Kumar Pathak
Patna High Court CWJC No.5827 of 2022(2) dt.29-11-2023 2/2 resident of Muhallah Police line, Bichal Telpa, Chhapra, Post + PS- Chhapra, Saran at present employee of Regional Executive Director (RED), N.T.P.C., Eastern Regional Head Quarter, Lok Nayak Jai Prakash, Bhawan, 2nd Floor, Dakbungalow Chowk, Patna- 800001 as her husband Pankaj Kumar Pathak died in harness on 28.12.2021. The petitioner with three children is the first class heir of late Pankaj Kumar Pathak and thus entitled to all legal out standing dues standing in the name of her husband in bank and Life Insurance company Office at Saran, Chhapra and with respondent No. 1 &2.
(ii) That the petitioner without any reservation is legally entitled to legal dues bank balance and policy of her late husband Pankaj Kumar Pathak who died on 28.12.2021."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
