The petitioner seeks bail in connection with Manigachhi P.S. Case No.171 of 2016 registered under Sections 366(A) and 372/34 of the Indian Penal Code.
The accusation is of enticing away the victim, the minor daughter of the informant, by this petitioner and unknown persons.
Learned counsel appearing on behalf of the petitioner submits that it would appear from paragraph-33 of the case diary that the victim left her parental house for the house of the petitioner according to her own sweet will on the call of the
Patna High Court Cr.Misc. No.3229 of 2017 (3) dt.01-03-2017 2/2 petitioner on the face-book. When the victim reached at the house of the petitioner then she found that the petitioner had pasted the photograph of another boy and cheated her but no illegal act was done by this petitioner with her. The victim has disclosed that she is major aged about 20 years and she also refused to be examined medically herself. Further submission is that the petitioner is handicapped and having no criminal antecedent is in custody since 15.09.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with Manigachhi P.S. Case No.171 of 2016.
