Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

The petitioner seeks anticipatory bail in connection with Bela P.S. Case No. 43/2020, registered for the offences under Sections 376, 323, 504, and 506 of the Indian Penal Code and Section 4 of the POSCO Act.

The petitioner is said to have established sexual relation with a minor girl and made her pregnant. Learned counsel for the petitioner submits that this is a case of love affairs and now the parties have entered into a compromise and compromise application has been filed by the prosecutrix.

Considered the submission of the parties. The allegation are serious in nature. Moreover the petitioner is tampering with the evidence.

Considering the aforesaid facts, this application for anticipatory bail is dismissed.

The petitioner is directed to surrender in the court below within two weeks from today. If he does not surrender within two weeks, the Superintendent of Police, Sitamarhi will take all coercive steps available in law for producing the petitioner in court so that the petitioner will face trial. Office is directed to communicate this order to the Superintendent of Police, Sitamarhi through FAX/e-mail forthwith.
