Petitioner seeks bail in Shastri Nagar P.S. Case No.487/18 registered for the offence under Sections 25(1-b),a, 26 and 35 of the Arms Act.

Allegation against the petitioner is of recovery of a country made pistol and a live cartridge from his flat. Submission on behalf of the learned counsel for the petitioner is that he has been falsely implicated in this case on the basis of the whole planted story as he was made accused in Vigilance P.S.Case No.32/18.

Heard the learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.63908 of 2018 (2) dt.26-10-2018 2/2 circumstances of the case, stated above, at this stage I am not inclined to grant bail to the petitioner. As such, prayer for bail of the petitioner is rejected with observation that after framing of charge against the petitioner or on completion of six months of the petitioner in custody, whichever is earlier, the petitioner may renew his prayer for bail.

This application is, accordingly, dismissed.
