Petitioner seeks bail in a case registered under Sections-25(i-b)a/26/35 of the Arms Act.
One country-made gun and five cartridges are said to have been recovered from the house of Kongressi Singh. The informant claims that having got confidential information, house of the petitioner was raided and the petitioner was apprehended. On interrogation, the petitioner disclosed that he had kept his illegal arms in the house of Gauri Singh and, thereafter, the informant learnt that the said arms have been kept in the house of Kongresi Singh. The informant has not disclosed as to how he came to know that the illegal arms have been shifted to the house of Kongresi Singh from the house of Gauri Singh and, therefore,

No.46199 of 2016 (2) dt.22-10-2016 2/2 even if, it assumed that the petitioner had disclosed that he had kept his arms in the house of Gauri Singh, then also, admittedly, nothing was recovered from the house of Gauri Singh. The petitioner does not have any criminal antecedent and is languishing in jail custody since 19-06-2016. Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Rohtas P.S. Case No. 119 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, DehriOn-Sone, Rohtas. (Hemant Kumar Srivastava, J) A.K.V./- U T
