JUSTICE SANJAY PRIYA ORAL ORDER 01-05-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Kasma P.S. Case No. 61 of 2016 instituted for the offence under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code. It is alleged that petitioner along with three other accused persons variously armed with lathi. danda and khanti came and started to carve out boundary on Gair Mazarua land and on protest, assaulted one Sunil Dutt who later on succumbed to the injury in the Hospital.
Case diary has been received.
In the post mortem report enclosed with the case diary, the doctor has found cause of death due to injury sustained by heavy, hard and blunt substance.
Patna High Court Cr.Misc. No.15009 of 2017 (3) dt.01-05-2017 2/2 There is allegation in the written report that petitioner with other accused persons assaulted Sunil Dutt with Khanti, danda etc. due to which he became unconscious and later on died. The injury and post mortem report corroborates the allegation. Therefore, this Court does not find it a fit case for grant of anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail which shall be disposed off by the court below on the same day in accordance with law without being prejudiced by this order.
