JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22.11.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 20 and 22 of the NDPS Act.

1.5 kg ganja is said to have been recovered from a vehicle in which the petitioner was found sitting. However, the aforesaid ganja had been kept between the petitioner and the driver of the said vehicle. Driver of the said vehicle has already been granted privilege of bail by another bench of this court vide order dated 11.10.2018 passed in Cr. Misc. no. 63515/2018.

Considering the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.65989 of 2018 (2) dt.22-11-2018 as well as submissions of the parties and also taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Bettiah, West Champaran in Nadi P.S. Case no. 22/2018.
