2. The petitioner apprehends his arrest in a case registered for the offence under Section 366(A)/34 of the Indian Penal Code.

3. As per the prosecution case, on 04.12.2023 at about 7:00 AM, the daughter of the informant went to attend coaching class, but she did not return to her house till evening. On search, the informant came to know that this petitioner alongwith his mother & father have kidnapped her daughter.

4. Learned counsel for the petitioner submits that the victim, in her statement recorded under Section 164 Cr.P.C., has denied the factum of kidnapping and stated that she has

Patna High Court CR. MISC. No.25574 of 2024(3) dt.27-06-2024 2/2 voluntarily gone with this petitioner to Ghaziabad and solemnized marriage there with him and now, she wants to live with him. The medical board has assessed the age of victim between 18 - 19 years. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State and learned counsel for the informant opposed the prayer for anticipatory bail.

6. Considering the statement of the victim recorded under Section 164 Cr.P.C., the prayer for anticipatory bail of petitioner is allowed. In the event of arrest/surrender before the Court below within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Khagaria P.S. Case No. 1230 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
