JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-07-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioner and Smt. Anita Kumari Singh, the learned APP for the State. The present petition, at the behest of the petitioner, for grant of regular bail, is a third attempt, inasmuch as his earlier prayers for grant of regular bail in connection Bakhtiyarpur P.S. Case No. 540 of 2017 for the offence punishable under Section 364(A) of the Indian Penal Code, have been rejected by this Court vide orders dated 28.06.2018 and 04.09.2019 passed in Cr. Misc. No. 21294 of 2018 and Cr. Misc. No. 55832 of 2019, respectively.

No.20656 of 2020(2) dt.09-07-2020 2/2 The petitioner is alleged to have committed serious offence of kidnapping of a minor boy and the victim boy has been recovered from the house of the petitioner, which prima facie fully establishes the complicity of the petitioner herein in the alleged crime.

Having regard to the facts and circumstances of the case and there being no change in circumstances as also considering the fact that the petitioner has been alleged to have been committed a grave offence, I do not find any reason to reconsider the case of the petitioner for grant of regular bail, hence the present petition stands dismissed.
