JUSTICE SANDEEP KUMAR ORAL ORDER 17-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Arer P.S. Case No. 147/2018, corresponding to G.R. No. 758/2018, registered for the offence punishable under Sections 304(B), 201/34 and 120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner has got clean antecedent. Petitioner is in custody since 23.11.2022.
Learned APP has vehemently opposed the prayer for bail.
From the F.I.R., it appears that the petitioner was in Calcutta when the deceased was killed and the entire thrust
Patna High Court CR. MISC. No.22778 of 2023(2) dt.17-05-2023 2/2 allegation is against the family members of the petitioner. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Benipatti, District- Madhubani, in connection with Arer P.S. Case No. 147/2018, corresponding to G.R. No. 758/2018.
This is also subject to the conditions that (I) the petitioner would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.
