Petitioner seeks bail in a case registered under section 392 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, one witness, Shanti Devi claimed that she had seen the petitioner and two others following the informant. Moreover, one Hira @ Hiralal Mandal was arrested and made his confessional statement naming the petitioner in the present case. It appears that except the aforesaid material as well as some criminal antecedent, there is nothing against the petitioner who is languishing in jail custody since 26.7.2016 but up till now, he has not been put on test identification parade.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
