JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-09-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 304B of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons are alleged to have committed the murder of daughter of informant for non fulfillment of demand of dowry.

Petitioner is husband of the deceased.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that informant himself admitted that he was informed by mobile that her daughter has been burnt and hospitalized at Sadar Hospital Nawada and from where she has

Patna High Court CR. MISC. No.21650 of 2022(3) dt.12-09-2022 2/2 been referred to Patna but in the way she died and as such no case u/s 304B of the IPC is made out against this petitioner. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that petitioner is husband of the deceased and the deceased died in her matrimonial home within seven years of her marriage under unnatural circumstances.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
