JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 498A/34 of the Indian Penal Code.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that earlier petitioner had filed a divorce case against the informant and thereafter, the present case has been lodged as a counter-blast to the filing of the earlier case by the petitioner and informant has alleged that petitioner had illicit relationship with some other lady and for that he used to torture her.

Heard learned A.P.P. also. He has opposed the prayer for anticipatory bail stating that after joining service petitioner started demanding motorcycle and after repeated

Having heard both sides, in view of the allegation made above, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected.

However, petitioner is directed to surrender in the court below, i.e., learned C.J.M., Begusarai, in connection with Mahila P.S Case no. 49 of 2016 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court.
