JUSTICE RAMESH KUMAR DATTA) 11-08-2015 Heard learned counsel for the petitioner and learned counsel for the Patna Municipal Corporation as also for the State. The contempt application has been filed alleging wilful disobedience of the order dated 31.07.2014 passed by this Court in

Patna High Court MJC No.4366 of 2014 (8) dt.11-08-2015 2/2 C.W.J.C. No. 8853 of 2014 in a public interest litigation. Several show causes have been filed and today also a supplementary show cause has been filed on behalf of the Executive Officer, Patna City Anchal, Patna Municipal Corporation, in which it is asserted that there is no debris to be found in the site in question and the dead Nala, which was not in use for the last twenty years, has also been cleaned by JCB/Poke lane machine, which is apparent from the letter of the petitioner dated 25.07.2015.

Learned counsel for the petitioner admits that substantial compliance of the order under contempt dated 31.07.2014 has been made by the opposite parties.

In the aforesaid facts and circumstances, the contempt application is dismissed.
